How this works in North Carolina.

NC adoption is governed by Chapter 48 of the General Statutes. The framework is uniform; the path depends on who is adopting, who is being adopted, and what consents are required.

Stepparent and relative adoptions are typically the most common in our practice. They involve termination (or relinquishment) of the rights of one biological parent, the consent of the other, and the establishment of the new legal parent-child relationship.

Whatever the path, adoption finalizes with a decree from district court — and from that moment, the legal relationship is exactly the same as if the child had been born to the adoptive parents.

The process

What to expect.

Here's the path through a typical adoption matter in North Carolina. Your case may move faster or slower depending on the facts; the structure is consistent.

    Pre-placement and consents

    We identify whose consent is needed and pursue or document each. In stepparent adoption, the spouse's consent and the non-parent's consent or termination of rights are the central work.

    Petition for adoption

    We file the petition in the county of the adoptive parents' residence with the supporting documents and consents.

  3. 03 / 06

    Pre-placement assessment (where required)

    Some adoptions require a pre-placement assessment by a licensed agency or social worker. Stepparent and many relative adoptions do not.

    Notice and waiting periods

    NC has procedural waiting and notice periods that apply differently by adoption type.

    Hearing

    The court holds a brief, often joyful hearing. Family members are welcome.

    Decree of adoption & new birth certificate

    The court enters the decree. We work with NC Vital Records to issue the amended birth certificate.
