How this works in North Carolina.

NC distinguishes between post-separation support (PSS — temporary support during the separation period) and alimony (longer-term support that follows). They have different standards, different evidentiary burdens, and different procedural rules.

To receive alimony, a spouse must establish that they are the dependent spouse, that the other is the supporting spouse, and that an award is equitable based on the statutory factors. Marital misconduct (including illicit sexual behavior) can affect entitlement and amount.

There are no formulas. Two cases with the same income and length of marriage can receive very different awards depending on the facts, the judge, and the quality of the presentation.

The process

What to expect.

Here's the path through a typical alimony matter in North Carolina. Your case may move faster or slower depending on the facts; the structure is consistent.

    Pleading

    PSS and alimony claims must be filed before the absolute divorce is entered. We file the appropriate complaint or counterclaim, identifying the dependent spouse status and the basis for the claim.

    Discovery

    Comprehensive financial discovery: income, expenses, lifestyle, debt, and (where relevant) marital misconduct evidence. NC affidavits of financial standing are required.

  3. 03 / 06

    PSS hearing (if requested)

    Where temporary support is needed, a separate PSS hearing is held — typically within 90 days of filing. The court enters interim support pending the alimony determination.

  4. 04 / 06

    Mediation

    Most alimony cases mediate. A negotiated alimony settlement allows the parties to control duration, structure, and tax treatment in ways the court won't.

  5. 05 / 06

    Trial

    If unresolved, the court holds the alimony trial. NC General Statutes 50-16.3A provides 16 factors the court must consider. Trial preparation is the work.

  6. 06 / 06

    Order

    The court enters the alimony order: amount, duration, modifiability, and termination conditions (often remarriage or cohabitation of the dependent spouse).
